We, Bath Taxis Limited, a company registered in England with company number 05431537 and registered office address of 2b Paxcroft Farm Industrial Estate, Hilperton, Trowbridge, BA14 6JB trading as SWOOP act only as an agent in respect of all bookings we take and/or make on your behalf.

For all journeys, your contract will be with the driver who accepts your booking (the “Supplier/Principal”).

 By making a booking with us, the first named person on the booking agrees on behalf of all persons detailed on the booking that he/she:

    1. read these Agency Terms & Conditions and agree to be bound by them;
    2. consents to our use of personal data in accordance with our Privacy Policy;
    3. is over 18 years of age;
    4. accepts financial responsibility for payment of the booking on behalf of all persons detailed on the booking.
  1. Contract

When making your booking through either our app or virtual operator, we will arrange for you to enter into a contract with the applicable Supplier/Principal (driver) of the Transport Arrangements.

As agent we accept no responsibility for the acts or omissions of the Supplier/Principal or for the services provided by them. Your booking with us is subject to these Agency Terms and Conditions and you are advised to read them carefully.

Your booking is confirmed and a contract between you and the Supplier/Principal will exist when we send you confirmation on their behalf. We are entitled, on behalf of the Supplier/Principal, to refuse any booking placed by you. We do not guarantee to successfully allocate a Supplier/Principal to every booking request. In the unlikely event that we are unable to allocate a Supplier/Principal to your booking request we will advise you where possible.

  1. Liability

We accept no liability in relation to any contract you enter into for any transport arrangements or other services you purchase, or for the acts or omissions of any supplier or other person(s) or party(ies) connected with any arrangements.

  1. Booking

You must check all of the information which you provide us with at the time of booking to ensure it is correct, including the pick-up information. Once you have confirmed these details we will proceed to confirm the booking with the Supplier/Principal.

Please check that all names, dates, timings and addresses are correct on any bookings made. The booking information that you provide to us will be passed on only to the relevant Supplier/Principal of your Transport Arrangements or other persons necessary for the provision of your Transport Arrangements. The information may be provided to public authorities if required by them, or as required by law. This applies to any special category (sensitive) information that you give to us. In making this booking, you consent to this information being passed on to the relevant persons.

  1. Payment

Payment can only be made to the Supplier/Principal (driver) directly, and in placing a booking through our app or virtual operator, you are committing at the time of booking to make such payment to the supplier/principal (driver).

Every supplier/principal has the facility to take payment via all major credit or debit cards.

If full payment is not received at the end of the journey, the Supplier/Principal may choose to pursue you legally for settlement of any unpaid amount.

  1. Prices

All prices quoted by our app are approximate – these merely serve as guidance as to the amount that the supplier will charge you for your requested journey.

Special note: changes and errors sometimes occur. You must check the price of your chosen Transport Arrangements at the time of being picked up by your supplier.

  1. Special requests

If you have any special requests, please let us know at the time of booking. We will pass on all such requests to the Supplier/Principal, but we can’t guarantee that they will be met and we will have no liability to you if they are not.

  1. Changes and Cancellations by You

Each of our Supplier/Principal’s allow you to cancel without charge provided that you cancel before they have arrived at your chosen pick up address. You can cancel your reservation through our app, or via our virtual operator.

Whilst we will try to assist, we cannot guarantee that the Supplier/Principal will meet any amendment requests. The Supplier/Principal may charge accordingly for any amendment made, which, if appropriate, they will negotiate directly with you.

  1. Changes and Cancellations by the Supplier/Principal

We will inform you as soon as reasonably possible if the Supplier/Principal needs to make a significant change to your confirmed Transport Arrangements or to cancel them. We will also liaise between you and the Supplier/Principal in relation to any alternative arrangements offered by the supplier but we will have no further liability to you.

  1. Our responsibility for your booking

Your contract is with the Supplier/Principal. As agent, we accept no responsibility for the actual provision of the Transport Arrangements. Our responsibilities are limited to making the booking in accordance with your instructions. We accept no responsibility for any information about the Transport Arrangements that we pass on to you in good faith. However, in the event that we are found liable to you on any basis whatsoever, our maximum liability to you is limited to twice the cost of the commission we earn on your booking (or the appropriate proportion of this if not everyone on the booking is affected).

  1. Complaints

Because the contract for your Transport Arrangements is between you and the Supplier/Principal, we will forward any queries or concerns about your Transport Arrangements to them to deal with. Please submit any such queries via email to: info@swoop.co.uk

Complaints must be submitted within 28 days of the date that you used the services provided by the Supplier/Principal. If you have a problem with your Transport Arrangements whilst using them, this must be reported to the Supplier/Principal immediately. If you fail to follow this procedure there will be less opportunity for the Supplier/Principal to investigate and rectify your complaint.

If you wish to complain about any service we have provided to you (i.e. our booking service) then please contact us directly.

  1. Law and Jurisdiction

These Agency Terms & Conditions are governed by English law and we both agree that the courts of England and Wales have exclusive jurisdiction (unless you live in Scotland or Northern Ireland, in which case you can bring proceedings in your local court under Scottish or Northern Irish law, as applicable).

  1. Vehicle Descriptions and Standards

All descriptions are as provided by the relevant Supplier/Principal. These are intended to give a guide to the facilities you should expect from your transport.

The images of the vehicle make and model shown on our app are for illustration purpose only and neither we nor the Supplier/Principal guarantee that these exact vehicles will be provided by the Supplier/Principal.

  1. Journey times

The distance and trip time provided are for planning purposes only. You may find that construction projects, traffic, weather, or other events may cause conditions to differ from the information published and you should plan your trip accordingly.

  1. Documentation & Information

All descriptions and content on our website or otherwise issued by us is done so on behalf of the Supplier/Principal in question and are intended to present a general idea of the services provided by the Supplier/Principal. Not all details of the relevant services can be included on our website. All services shown are subject to availability.
